Founder and Director of POS Foundation, Mr Jonathan Osei Owusu, narrated the ordeal of the man who spent six years in Koforidua Prison despite his case being dismissed by a Mampong court.
He said the accused had been acquitted but had served time in prison for police misconduct.
A look back at this issue JoyNews LawOsei Owusu said the man was charged with murder and detained for a year before a pathology test revealed that the cause of the alleged victim’s death was pneumonia and not crime.
As a result, the Mampong court dismissed the case and effectively ordered the release of the defendants, who however remained in custody.
“our company’s [Justice for All] The police officer said that he was trying to take him to court with his own money, [the accused] You will need to pay for transportation.
“The accused couldn’t and I don’t know if he used a warrant somehow but I found this man six years later in Koforidua Prison,” he said.
Human rights activists lamented that such actions by some police officers contributed to corruption in the justice system.
He reiterated the warning given by Justice Angelina Mensah Homia to the police that “if the court dismisses a case, the accused should not be re-detained under any circumstances.”
“We have come across others in prison who are still being held despite court orders for their release.
“The police get some detention warrants and send them to jail without our knowledge. In such cases, the police CID does not get absolved,” he said.
