Professor Stephen Kwaku Asare, popularly known as Kwaku Asare, a Ghanaian lawyer and academic based in the United States, has issued an order purportedly issued by Chief Justice Gertrude Turkornou for the arrest of Police Prosecutor Akolgo Yakubu Ayamuga. In a post shared on Facebook on Wednesday, January 31, 2024, Kwaku Azar said it was shocking that the case could not be traced even though it happened during a trial at the Supreme Court of Ghana. He said that it was accurate.
He added that the public has the right to know exactly what happened between Chief Justice Turkolnu and Assistant Superintendent of Police (ASP) Yakubu Ayamuga.
“The public has the right to know whether and why Mr. Ayamuga was arrested and detained in the Supreme Court.
“Furthermore, if he was arrested and detained, why did the Registrar state that (i) there was no written record; (ii) there was no audio or video recording due to ‘power fluctuations’; and (iii) Did he mention that he was not arrested? Is it as Mr. Ayamuga, a lawyer and police official, claims? ” Hazard asked.
He added: “The arrest and detention were announced in the media on November 15, 2023. Therefore, if the registrar’s statements were indeed made, it raises serious concerns.” These are matters of public interest that concern the credibility of the Supreme Court’s procedures. ”
Meanwhile, a senior police officer and lawyer, ASP Akolgo Yakubu Ayamuga, dragged the Chief Justice to the Commission on Human Rights and Administrative Justice (CHRAJ).
He accused CJ Gertrude Turcornu of abusing her office and authority after she ordered his arrest during a Supreme Court session in November 2023.
Mr. Ayamuga disproved in detail media reports on the matter, explaining the sequence of events leading up to his arrest, saying that his actions were “influenced by growing anger, prejudice and malice on the part of the presiding judge. Abuse of judicial power.”
He further indicated that no arrests were found in the court record during a formal trial as a result of the check, which, in his view, was a deliberate failure of the true sequence of events. He explained that it was a cover-up.
In the final paragraph of the rejoinder, he acknowledged that he had reported CJ to CHRAJ.
“CHRAJ is an independent, impartial, constitutional and reasonable ombudsman to investigate abuses of power and cover-ups by public servants. I therefore submit a complaint to the Director-General of CHRAJ to investigate abuses of power and cover-ups by the Chief Justice’s wife. ”, the retrial concluded.
Ayamuga version of events:
According to Mr. Ayamuga, the incident occurred during the argument of a case in the Supreme Court, where he presented his case respectfully, boldly and fearlessly.
However, the presentation was interrupted by Chief Justice Turkornou’s remark, “You’re screaming,” and he was ordered to return to his seat.
The disagreement further escalated when the Chief Justice allegedly made offensive comments that questioned Mr. Ayamuga’s competency and professionalism. Ayamuga maintained that he had calmly and respectfully objected to these statements and had the Chief Justice order his arrest.
According to his account, Ayamuga was immediately arrested by a subordinate police officer, taken outside the courtroom, and illegally detained for about two hours.
Mr. Ayamuga maintains that his arrest has nothing to do with his disagreement with the court’s ruling, as first reported in the media. He argued that he should not be arrested simply because he disagreed with the judge’s disrespectful comments, stressing that he had complied with the arrest without any hindrance.
“Speculations aside, respectfully and fearlessly disagreeing with a judge’s judgment is not a criminal offense that warrants arrest and detention. Arrests are unconscionable, unreasonable, and An independent person with information who is impartial, reasonable, fair-minded, and without due process.
“This arrest was simply influenced by anger, prejudice, and premeditated malice, constituting fraud and abuse of judicial prestige by the presiding judge,” the prosecutor said in the retrial.
