Barima Nana Yaw Kodi Oppong, director of the Ghana Law School, said prenuptial agreements could be considered illegal in Ghana.
He said such agreements could be considered invalid because the constitution dictates how property acquired during a marriage is divided at the end of the marriage.
He said this on JoyFM’s Super Morning Show on Friday, November 3, when discussing the marital property division.
“But we don’t have a prenuptial agreement, a prenuptial agreement that’s talked about in public. I would say that under the current constitution, it could be declared illegal. It depends on whether you also go to court and argue.
“However, this is because the Constitution stipulates that property acquired during marriage is related to the continuation of the marriage, and if there is evidence of joint acquisition, it will be subject to distribution upon dissolution of the marriage. is.”
βSo even during our marriage, or before you agreed that this land is mine, or when I acquired three houses in Accra, two One will be mine and one will be yours.
βThe constitution sets out criteria for decisions, so it can be difficult, especially if one person dies, and that to me is bigger than dissolution,β he explained.
The discussion comes in the wake of the recent dissolution of the marriage between former Ghana national team captain Asamoah Gyan and his ex-wife Gifty.
The former Ghanaian international player was ordered to pay Sh25,000 a month in welfare and child support for his three children with his ex-wife.
Grinsh 25,000 will be paid for welfare and child support for the three children, which does not include education, medical and dental expenses, air tickets for travel and other expenses.
Mr Gyan also plans to compensate his ex-wife with a house he owns in the UK and another four-bedroom house in Ghana, land and several cars.
